Celebrities Seek Court To Dismiss Latest EthereumMax Lawsuit

Celebrities Paul Pierce, Floyd Mayweather, Kim Kardashian, and others ask the court to dismiss a new EthereumMax lawsuit. The defendants in the EthereumMax (EMAX) lawsuit want the latest charges against them to be thrown out by the California Central District Court.
In December, U.S. District Judge Michael W. Fitzgerald threw out a class-action lawsuit that said reality TV star Kim Kardashian, NBA legend Paul Pierce, boxing champion Floyd Mayweather Jr., and other defendants falsely promoted the EthereumMax ERC-20 token.
After the amended complaint was filed, the defendants asked the court to drop the charges in a motion on January 7.
They say that the new allegations are the same as those in the case that was thrown out before. In that case, it was said that they promoted EMAX to artificially raise its value, which led investors to buy tokens at a higher price.
“Court previously found this theory implausible because the Tokens have no worth outside of what the market is willing to pay for them in real time.
The Court otherwise dismissed the prior complaint in full due to fundamental flaws. The addition of new claims, Defendants, and over 100 pages of largely irrelevant allegations does not cure the defects.”
Last week, the U.S. Securities and Exchange Commission (SEC) said that it had filed charges against Pierce for making false and misleading advertising claims about EMAX. The basketball player agreed to pay $1.41 million in fines, restitution, and interest as part of a settlement.
In October, the same type of charge was brought against Kardashian. The media person agreed to pay the $1.26 million fine to settle the charges.
